Welcome to WillyWally. These Terms and Conditions (“Terms”) govern your access to and use of the WillyWally website (our “Site”) and any purchases or services provided through the Site. By accessing our Site or placing an order with us, you (the “Customer” or “you”) agree to be bound by these Terms, as well as our Privacy Policy (and other policies referenced herein). If you do not agree to these Terms, you should not use our website or services.
Throughout these Terms, “WillyWally”, the “Company,” “we,” “us,” or “our” refers to WILLYWALLY Sp. z o.o., a company registered in Poland (VAT PL5223274903) with registered office at Bohaterów Warszawy 23/2, 02-495 Warsaw, Poland, which owns and operates the WillyWally brand and this Site. WillyWally is the trading name under which we offer products via this Site. We may use third-party partners and logistics providers for packaging, warehousing, and dispatch services, but all contracts of sale are concluded with WILLYWALLY Sp. z o.o.

Please read these Terms carefully before using our Site or ordering products. They contain important information about your legal rights, remedies, and obligations.
1. Use of the Website
1.1 Eligibility
By using our Site, you represent that you are at least the age of majority in your country (for example, 18 years old in most EU countries) or that you have the consent of a parent or legal guardian to use the Site. You may not use the Site if doing so is prohibited by local laws or regulations.
1.2 Account Creation
Some features of our Site (such as placing an order or writing a review) may require creating an account. When you create an account, you agree to provide accurate, current, and complete information about yourself, and to update such information promptly if it changes. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must not share your account credentials with others. If you suspect any unauthorized use of your account or any other security breach, you must notify us immediately at care@willywally.com. We are not liable for any loss or damage arising from your failure to keep your account information secure.

1.3 Permitted Use
You agree to use the Site for lawful purposes only. You must not misuse our Site by knowingly introducing viruses, trojans, worms, or other material that is malicious or technologically harmful. You agree not to attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site, by hacking, password mining or any other illegitimate means. We reserve the right to suspend or terminate your access to the Site if we suspect any unauthorized or illegal activity.
1.4 Website Content
All content on our Site, including text, images, graphics, logos, design, software, and the arrangement thereof, is owned by or licensed to WillyWally and is protected by intellectual property laws (see Section 5 below). You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Site content without our prior written consent, except for personal, non-commercial use of the Site as intended.
2. Products and Orders
2.1 Product Information
We strive to display product images, descriptions, and specifications (such as dimensions, colors, and materials) as accurately as possible on our Site. However, slight variations may occur (for example, colors might appear differently on different monitors or handmade items might have minor unique variations). These natural variations are not considered defects. If you have any questions about a product, please contact us before purchase.
2.1a Product Safety
Some sets may include small items (e.g., stickers, tape and/or stationery). These items are not intended for children and may present a choking hazard if swallowed. Keep products and any small items out of reach of children and pets. Do not ingest.
If adhesive items are included, please note that wall materials, paint and finishes vary. Use of any adhesive items is at your own risk. We are not responsible for damage to walls, paint, wallpaper or other surfaces resulting from the use of adhesive items.
2.2 Pricing
All prices on our Site are listed in Euro (EUR) or other currencies where specified.
● EU Customers (B2C): VAT is calculated automatically at checkout in accordance with EU VAT rules and included in the total shown at checkout before payment.
● Non-EU Customers: Import taxes (e.g., VAT/GST), customs duties, and clearance fees, if applicable in the destination country, are the responsibility of the buyer/recipient and are not included in the price unless expressly stated at checkout.
We reserve the right to adjust our prices or VAT treatment if required by law or due to changes in our tax registrations.
2.3 Order Process
By placing an order through our Site, you are making an offer to purchase the selected product(s) in accordance with these Terms. After you submit an order, you will receive an email confirmation acknowledging that we received your order. This initial order confirmation does not yet constitute acceptance of your order; it is simply an acknowledgment. All orders are subject to acceptance by us. We reserve the right to accept or decline any order at our discretion. Reasons for non-acceptance may include, for example: the product is out of stock or discontinued, we identify a pricing or product description error, or we are unable to obtain authorization for your payment.
2.4 Formation of Contract
A binding contract of sale between you and WillyWally is formed only when we issue a shipping confirmation email, explicitly confirming that the product has been dispatched. (If your order is dispatched in multiple parts, you may receive separate shipping confirmations for each part; each such confirmation constitutes a contract for the items listed in that email.) Prior to dispatch, if we notify you of non-acceptance of your order or if you cancel the order, no contract is formed, and any payment you have made will be refunded.
2.5 Payment
Payment must be made at the time of ordering by an approved payment method. We accept various payment methods as indicated at checkout, such as credit/debit cards, PayPal, etc. By providing payment details, you confirm that you are authorized to use the chosen payment method and you authorize us (or our designated payment processor) to charge the full amount of your order (including any applicable taxes and shipping fees) to that payment method. If your payment cannot be processed or is declined, your order will not be accepted. We are not responsible for any fees or charges (e.g., foreign transaction fees) that your bank or card issuer may apply.
2.6 Currencies and International Orders
If we offer pricing in multiple currencies, the currency of your transaction will be determined based on your shipping country or your selection on the website.
Please note:
● If your payment account is in a different currency than the one displayed at checkout, your bank may charge currency conversion fees.
● For EU customers, VAT is included as described above.
● For deliveries outside the European Union, import VAT/GST, customs duties and clearance fees may apply. These charges (if applicable) are the responsibility of the recipient and are not included in the price shown at checkout, unless expressly stated otherwise.
● Customs clearance procedures may cause delays outside our control.
2.7 Promo Codes and Offers
Promo codes have no cash value, are non-transferable, and cannot be redeemed for cash. Unless expressly stated otherwise, only one promo code may be used per order. Promo codes and discounts cannot be applied retroactively. If you return an item, any discount applied is not paid out as a separate cash amount (unless required by law).
3. Shipping and Delivery
3.1 Shipping Policy
We will arrange for delivery of the products to the address you provide at checkout. Delivery costs and estimated delivery times will be presented to you at checkout. While we strive to meet stated delivery estimates, these are estimates only and not guaranteed. Actual delivery times may vary due to stock availability, courier delays, customs processing (where applicable), or other factors beyond our control. Please refer to our Shipping & Returns Policy (provided on a separate page and incorporated into these Terms) for additional information on processing times, shipping methods, costs, and related terms.
3.2 Customs and International Delivery
If you order products for delivery to a country outside of our local region, your package may be subject to import duties, taxes, or customs clearance fees imposed by that destination country. As stated in our Shipping & Returns Policy, such charges are your responsibility and are not included in the purchase price or shipping cost we charge. We have no control over these fees and cannot predict their amount. We recommend you check with your local customs office for information on potential import costs before placing an order. We are not responsible for delays caused by customs. Additionally, if a package is refused or returned to us due to unpaid customs fees or an incorrect address provided by you, we may treat it as a return (subject to our Returns Policy) or deduct any return shipping costs from any refund, as appropriate.
3.3 Risk of Loss
The risk of loss or damage to products passes to you when the goods are delivered to you or to a person designated by you. If you instruct the carrier to leave the parcel in a designated safe place or with a neighbour/concierge/reception, delivery to that place or person will be deemed delivery to your designated person. If the shipment is marked as delivered by the carrier but you have not received it and you did not provide such instructions, please contact us promptly; we will assist you in opening an investigation with the carrier and will act in accordance with applicable law.
3.4 Failed Delivery or Return to Sender
Please double-check your delivery address and information when placing your order. If a parcel is returned to us due to an incorrect or incomplete address provided by you, or because it was unclaimed, we will contact you for clarification. You may be responsible for additional shipping fees to re-send the package. We reserve the right to cancel the order in such cases and refund the product price, excluding original shipping costs, especially if we cannot obtain correct address information from you. As noted in our Shipping & Returns Policy, if orders are returned to us without prior notice or due to refusal at customs or delivery, we have the right to reject such returns if they do not comply with our Return Policy.
4. Returns and Refunds
4.1 Return Policy
We accept returns where required by applicable consumer protection laws, including the EU statutory right of withdrawal described below. This section does not affect or limit your statutory rights in relation to faulty, damaged, or misdescribed goods.
4.1a EU Right of Withdrawal
If you are a consumer in the European Union, you have the statutory right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period ends 14 days after the day on which you, or a third party indicated by you (other than the carrier), takes physical possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement (for example, by email to care@willywally.com) before the withdrawal period expires.
After we receive your withdrawal notice, we will email you the return address and instructions. No specific form is required.
We will reimburse all payments received from you, including the cost of delivery (where applicable), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.
You must send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. You will bear the direct cost of returning the goods for change-of-mind withdrawals unless we state otherwise. If the return is due to a confirmed defect, damage in transit, missing items, or a wrong item, we will cover the reasonable cost of return shipping (for example by providing a prepaid label or reimbursing reasonable postage).
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. If a poster has been mounted or hung (for example using stickers or tape), or if the item is damaged, soiled, or otherwise cannot be resold as new, we may reduce the refund to reflect the diminished value. In some cases, the reduction may be up to the full price of the item.
4.2 Defective or Damaged Products
We stand behind the quality of our products. In the unlikely event that you receive an item that is defective, damaged, or not what you ordered, please contact us at care@willywally.com. Provide your order number, details of the issue, and if possible, photographs of the defect or damage. We will evaluate your request, and if the product is indeed faulty or not as described, we will arrange for a return or exchange at our expense. We may provide you with a return shipping label or instructions on how to send the item back. Upon receipt and inspection of the returned item, we will either send you a replacement (if available) or issue a full refund (including any original shipping costs). We reserve the right to reject return requests if the product is found to be in good condition and as advertised.
4.3 Exceptions – Consumer Rights
Nothing in these Terms is intended to exclude or limit your statutory rights under applicable consumer protection laws.
The EU right of withdrawal does not apply in certain cases provided by law (for example, goods made to the consumer’s specifications or clearly personalised, and certain sealed goods once unsealed for health or hygiene reasons). Where an exception applies, it will be indicated before you place your order.
4.4 Return Procedure
For any authorized returns (such as for defects), items should be returned in their original packaging (if possible) and well-protected. You are responsible for the items until they reach us, so please ensure secure packaging. We recommend using a trackable shipping method and purchasing shipping insurance, especially for higher-value items. We cannot be responsible for returns lost in transit if you choose to handle the return shipping yourself.
4.5 Refunds
Once a return (for defects or other approved reasons) is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within a certain number of days (typically 5–10 business days). If you haven’t received an expected refund, please first check with your bank or credit card provider, as there is often some processing time before a refund is officially posted. If you’ve done this and still have not received your refund, please contact us.
5. Intellectual Property
5.1 Ownership
All content and materials on the WillyWally Site, including but not limited to text, graphics, logos, button icons, images, photographs, audio clips, video clips, downloads, data compilations, and software, are the property of WillyWally or its content suppliers and are protected by intellectual property laws (such as copyright, trademark, and design rights). The compilation of all content on this Site is the exclusive property of the Company.
5.2 Trademarks
“WillyWally” and all related logos, product and service names, designs, and slogans are trademarks or service marks of WILLYWALLY Sp. z o.o. (whether registered or unregistered). You must not use any such marks without our prior written permission. All other names, logos, or marks on the Site that are not owned by us are the property of their respective owners (for example, third-party brand names that may appear when referencing materials or integrations).
5.3 Limited License
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. This license does not include any resale or commercial use of the Site or its contents; any collection and use of product listings, descriptions, or prices; any derivative use of the Site or its contents; or any use of data mining, robots, or similar data gathering and extraction tools. You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit any portion of the Site for any commercial purpose without our express written consent.
5.4 User-Generated Content
If our Site allows you to post reviews, comments, or other user-generated content (“UGC”), you retain ownership of any intellectual property rights in the content that you create and submit. However, by posting UGC on our Site or social media pages, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content throughout any media. This license is solely for the purpose of operating, marketing, or improving our services (for example, we might feature your customer reviews on our website or social channels). You represent that you have all necessary rights to the content you post and that such content does not infringe any third-party rights or violate any laws. We reserve the right to remove or edit any UGC for any reason.
6. Limitations of Liability
6.1 Warranty Disclaimer
To the maximum extent permitted by law, WillyWally provides the Site and all products and content on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. While we strive for accuracy, we do not guarantee that the product descriptions, prices, or other content on the Site are complete, accurate, or current at all times. Except as expressly provided in these Terms, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
6.2 Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall WillyWally or its owners, directors, officers, employees, affiliates, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for lost profits, lost revenue, loss of data, loss of goodwill, or business interruption) arising out of or in connection with your use of (or inability to use) the Site or products, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
6.3 Maximum Liability
Our aggregate liability to you for all claims arising from or related to these Terms or the use of our products or Site shall not exceed the amount you paid to us for the product or service in question. For example, if your claim relates to a purchase, our liability is limited to the price you paid for that purchase (including any shipping fees). If your claim relates solely to your use of the Site without a purchase, our liability (if any) will be limited to the maximum extent permitted by applicable law.
6.4 Exceptions
The above warranty disclaimers and limitations of liability do not limit or exclude liability that cannot be limited or excluded under applicable law. For instance, they do not exclude our liability for personal injury or death caused by our negligence or for fraud or fraudulent misrepresentation. Additionally, certain consumer protection laws may give you specific rights that cannot be waived; in such cases, our liability will be limited to the maximum extent permitted by those laws.
6.5 Indemnification
You agree to indemnify, defend, and hold harmless WillyWally and its affiliates, and each of our respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (a) your breach of these Terms; (b) your misuse of the Site or products; (c) your violation of any law or the rights of a third party; or (d) content you post or submit (including UGC). We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim.
7. Miscellaneous
7.1 Privacy
Your submission of personal information through the Site and our handling of it is governed by our Privacy Policy (see above or on the dedicated page). By using our Site or ordering products, you acknowledge that you have read and understood our Privacy Policy, which describes how we collect, use, and share your data.
7.2 Third-Party Links and Tools
Our Site may include links to third-party websites or services that we do not own or control (e.g., Instagram, Facebook, or third-party payment gateways). Additionally, we might provide you with access to third-party tools or plugins (e.g., a chatbot or social media sharing tool) which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such third-party links or tools “as is” without any warranties. We are not responsible for the content or practices of any third-party websites or services. Your use of third-party sites or tools will be governed by their own terms and policies, which we advise you to review.
7.3 Force Majeure
We shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is due to unforeseen events beyond our reasonable control, such as acts of God, war, terrorism, civil commotion, industrial disputes, pandemic, natural disasters, failure of telecommunications or the internet, or other events of force majeure. During such events, our obligations are suspended for the period of the event. We will use reasonable efforts to mitigate the effect of a force majeure event and resume our obligations as soon as feasible.
7.4 Changes to Terms
We reserve the right to modify these Terms from time to time. If we make significant changes, we will post the updated Terms on our Site and update the “Last Updated” date. In some cases, we may notify you (via email or by a notice on our homepage) of major changes. By continuing to use the Site or our services after the new Terms are in effect, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, you should stop using the Site and (if applicable) cancel any outstanding orders where permitted.
7.5 Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Shipping & Returns Policy, and any other policy or document expressly referred to in these Terms, constitute the entire agreement between you and WillyWally regarding your use of the Site and purchase of products. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including any prior versions of the Terms).
7.6 Severability
If any provision of these Terms is found by a court or competent authority to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision will be interpreted or replaced so as to accomplish as closely as possible the original intent and economic effect of the provision, to the extent permitted by law.
7.7 No Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver by us of a breach of any provision of these Terms shall not operate as a waiver of any succeeding breach.
7.8 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, sale of assets, change of corporate name, or by operation of law, or otherwise at our discretion.
7.9 Governing Law
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Poland, without giving effect to any conflict of laws principles that would result in the application of the law of another jurisdiction. We choose the laws of Poland because our business presence is established in Poland.
If you are a consumer resident in a member state of the European Union, you may also benefit from any mandatory provisions of the law of your country of residence which cannot be waived by agreement.
7.10 Dispute Resolution
Any dispute arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, that cannot be resolved amicably through negotiations within 30 days shall be subject to the exclusive jurisdiction of the competent courts of Poland, specifically the courts of Warsaw, unless applicable law in your country of residence requires that disputes be resolved in that jurisdiction (in which case you can bring proceedings there). Notwithstanding the foregoing, we reserve the right to seek injunctive or equitable relief in any jurisdiction to protect our intellectual property or confidential information.
